New Reporting Requirement

The Financial Crimes Enforcement Network (FinCen) has a new reporting rule requirement for entities entering into an all-cash residential real estate transaction. This requirement came into effect on March 1, 2026. The escrow closing officer assigned to any given file will be required to report to FinCen, information about the actual individual owner behind the entity. This is not a tax and doesn’t change property ownership rights or values. Ultimately, this is a federal anti-money laundering barometer to increase transparency in all real estate transactions. There is a small fee paid by the buyer in the transaction for this reporting. Buyers using traditional financing vesting in their personal legal names will conduct a purchase without this requirement, business as usual. Please reach out to me with any questions. Your Title Report

Review your title report and be aware of its contents. Confirming your name spelling, marital status, vesting, and policy commitment amount accuracy is of utmost importance. Your purchase and sale agreement will drive these initial basic terms, and the title company will include these details in the report. There are differences between each schedule within the report. It’s imperative to understand what covenants, conditions, restrictions, and/or easements that exist with the property. Have questions? We know title examiners with answers.
